1.2 Purpose

These Terms apply exclusively to the online sale of Nuchu products to customers purchasing through the mynuchu.co.uk website ("Website"). They constitute the entire agreement between Nuchu Nutraceuticals Limited ("we", "us", "the Company") and the customer ("you", "Customer") in respect of each order placed.

1.3 Applicability

These Terms apply to sales made to consumers as defined under the Consumer Rights Act 2015 — that is, individuals acting for purposes wholly or mainly outside their trade, business, craft or profession. They do not apply to business-to-business transactions.

By placing an order, you confirm that you have read, understood and accepted these Terms.

You must be at least 18 years of age to purchase products from this Website. The purchase of products by a person under 18 requires the express consent of a parent or legal guardian.

Food supplements should be taken as part of a varied and balanced diet and a healthy lifestyle. They are not a substitute for a balanced diet or medical treatment. If you have any medical condition, are pregnant, breastfeeding, or taking medication, please consult a doctor or qualified healthcare professional before using our products.

3. Orders

3.1 Placing an Order

3.3 Right to Refuse Orders

We reserve the right to decline an order at our discretion, including in cases of suspected fraud, unpaid previous orders, or where a product is out of stock. If we are unable to fulfil your order, we will notify you and provide a full refund of any payment made.

4. Subscriptions

4.1 Subscribing

We offer a subscribe-and-save option on our products. By selecting a subscription at checkout, you authorise us to charge your payment method on a recurring basis at the interval you select (typically monthly). Subscription pricing and any applicable discount are shown clearly at checkout before you confirm.

4.2 Cancelling a Subscription

You may cancel your subscription at any time by logging into your account on the Website or by emailing support@mynuchu.com. To avoid being charged for the next order, cancellation must be made at least 3 days before your next scheduled renewal date. Orders already processed and dispatched cannot be cancelled.

Cancelled subscriptions will not be refunded for any order that has already been dispatched.

4.3 Withdrawal from Subscription

For subscriptions involving regular delivery of goods, your statutory right of withdrawal runs from the date you receive the first delivery. See Section 10 for details.

 

5. Pricing

5.1 Prices

All prices are displayed in pounds sterling (GBP) and are inclusive of VAT at the applicable rate. Delivery costs, where applicable, are shown separately at checkout before you confirm your order.

We reserve the right to change our prices at any time. The price charged will be the price shown on the Website at the time you place your order.

5.2 Promotions

Where a promotional price is advertised, the promotional price will apply to orders placed during the promotional period only.

5.3 Invoicing

An invoice or order confirmation will be sent to you by email after your order is placed.

 

6. Payment

6.1 Payment Methods

Payment is due in full at the time of ordering. We accept the payment methods displayed at checkout. Your order will not be processed until payment has been successfully received.

6.2 Security

All payment transactions are processed securely. Card details are encrypted and are not stored by us.

6.3 Failed Payment

If a payment fails or is refused, we will not process or dispatch your order. If a payment is subsequently reversed or charged back, we reserve the right to suspend your account and recover any outstanding amounts.

 

7. Delivery

7.1 Delivery Areas

We deliver to addresses within the United Kingdom. We may also deliver to certain international destinations as listed on the Website. If your address is not covered, you will be notified at checkout.

7.2 Delivery Times

UK orders are typically dispatched within 1 business day of order confirmation. Estimated delivery times after dispatch are between 1 and 2 business days for standard delivery within the UK. These are estimates and not guaranteed. Delays may occur due to carrier issues or circumstances outside our control.

7.3 Delivery Costs

Delivery charges, if applicable, are shown at checkout before you confirm your order.

7.4 Failed Delivery

If a parcel cannot be delivered and is returned to us, we will contact you to arrange re-delivery. A charge may apply for re-dispatch. If you refuse delivery without a valid reason, return costs may be deducted from any refund.

7.5 Risk and Ownership

Risk in the products passes to you upon delivery to the address you specified. Title to the products passes to you upon receipt of full payment.

 

8. Consumer Rights and Statutory Guarantees

Under the Consumer Rights Act 2015, all products we sell must be:

• Fit for purpose

If a product does not meet these standards, you are entitled to a repair, replacement or refund depending on the circumstances and timing of your complaint. Your statutory rights are not affected by anything in these Terms.

 

9. Defective or Incorrect Products

If you receive a product that is defective, damaged, or not what you ordered, please contact us as soon as possible at support@mynuchu.com, providing your order number and, where possible, photographic evidence of the issue. We will arrange a replacement or refund at no cost to you, including any return postage where applicable.

Complaints about visible damage or incorrect items should be raised within 14 days of receipt.

 

10. Right to Cancel (Withdrawal)

10.1 Your Right to Cancel

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2014, you have the right to cancel your order within 14 days of receiving your goods, without giving a reason, subject to the exceptions in clause 10.4.

The cancellation period expires 14 days after the day you (or someone you nominate) receive the products. For subscription orders involving regular deliveries, the 14-day cancellation period begins from the date you receive the first delivery.

10.2 How to Cancel

To exercise your right to cancel, notify us before the cancellation period expires by:

You may use any clear written statement expressing your wish to cancel, including the model cancellation form available on request. We will acknowledge receipt of your cancellation by email.

10.3 Returning Products

Following cancellation, you must return the products to us without undue delay and no later than 14 days after the day you notified us of your cancellation. Products must be returned unused, unopened, and in their original packaging, with the hygiene seal intact. You are responsible for the cost of return postage unless the product is defective or incorrectly supplied.

10.4 Exceptions to the Right to Cancel

In line with Regulation 28(3)(b) of the Consumer Contracts Regulations, the right to cancel does not apply to products which are sealed for health protection or hygiene reasons and which have been unsealed after delivery. In practice, this means we cannot accept the return of any product that has been opened, partially consumed, or whose hygiene seal has been broken.

10.5 Refunds

If you cancel within the 14-day period and return the products in accordance with clause 10.3, we will refund the full purchase price including the standard delivery cost you paid when placing the order. We are not required to refund any additional cost arising from your choice of a delivery option more expensive than the cheapest standard delivery we offer.

Refunds will be processed within 14 days of either the day we receive the returned goods, or the day you provide evidence that you have returned them, whichever is earlier. Refunds will be made using the same payment method you used to place the order, unless you have expressly agreed otherwise.

 

11. Limitation of Liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited under English law.

Subject to the above, we are not liable for any indirect or consequential losses arising from your use of our products. Our total liability to you in connection with any order shall not exceed the amount you paid for that order.

We are not liable for losses arising from your failure to follow usage instructions, your failure to disclose relevant medical information, or individual variation in product effects.

 

12. Intellectual Property

All content on the Website, including text, images, logos, and product descriptions, is the property of Nuchu Nutraceuticals Limited or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute or use any content from the Website without our prior written permission.

 

13. Personal Data and Privacy

We collect and process your personal data in accordance with UK GDPR and the Data Protection Act 2018. Our Privacy Policy, available on the Website, explains what data we collect, how we use it, and your rights in relation to it.

We may share your contact details with delivery carriers solely for the purpose of fulfilling your order. We do not sell your personal data to third parties.

17. Disputes and Governing Law

These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms or your order shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable consumer protection law requires otherwise.

Nothing in these Terms affects your statutory rights as a consumer under UK law.

 

18. Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right under these Terms does not constitute a waiver of that right.

Force majeure: we are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, or disruption to supply chains or carrier services.
